  1. Controller / Provider of Data Processing Services

Controller within the meaning of Art. 4 No. 7 General Data Protection Regulation (hereinafter “GDPR”) is Electromach B. V., Jan Tinbergenstraat 193, 7559 SP Hengelo, Netherlands, email: data.protection@r-stahl.com (hereinafter “us“ or “we“).

  1. Information We Collect

We may collect the following types of personal information:

  • Contact Information: such as your name, email address, phone number, and postal address.
  • Professional Information: including your resume, cover letter, work experience, education, skills, references, and other information you provide in your job application.
  • Identification Information: such as your date of birth and national identification numbers, if required.
  • Technical Information: like your IP address, browser type, and usage data collected through cookies and other tracking technologies.
  1. How We Use Your Information

We use your personal data for the following purposes:

  • Recruitment: To process your job application, evaluate your qualifications, and communicate with you during the recruitment process.
  • Compliance: To comply with legal and regulatory requirements.
  • Improvement: To improve our recruitment processes and website functionality.

The legal basis for the data processing is Art. 6 para. 1 lit. b GDPR, Art. 6 para. 1 lit. c GDPR and Art. 6 para. 1 lit. f GDPR. The processing is necessary to take steps at your request prior to entering a working contract. There are legal obligations we must comply with. Our legitimate interest is based on the purposes of data collection as listed above.

  1. How We Share Your Information

Your personal data will not be transmitted to third parties for purposes other than those listed below.

We will only pass on your personal data to third parties if:

  • you have given your express consent pursuant to Art. 6 para. 1 sentence 1 lit. a GDPR,
  • the disclosure pursuant to Art. 6 para. 1 sentence 1 f is necessary to establish, exercise or defend legal claims and there is no reason to assume that you have an overriding interest deserving protection in non-disclosure of your data,
  • in the event that a legal obligation exists for the transfer pursuant to Art. 6 para. 1 sentence 1 lit. c GDPR, and
  • this is legally permissible and is necessary for the processing of contractual relationships with you in accordance with Art. 6 para. 1 sentence 1 lit. b GDPR.

We may share your personal data with:

  • Affiliates: Our parent company, subsidiaries, and affiliates for recruitment and administrative purposes.
  • Legal Obligations: Authorities and other third parties as required by law or to protect our rights.
  1. Transfer to Third Countries

In the event that we process data in a Third Country (i.e., outside the European Union (EU) or the European Economic Area (EEA)) or such processing occurs in the context of utilizing third-party services or disclosing or transferring data to third parties, this only takes place to the extent that is necessary to fulfil our (pre)contractual obligations pursuant to Art. 6 para. 1 lit. b GDPR, on the basis of your consent pursuant to Art. 6 para. 1 lit. a GDPR, on the basis of a legal obligation to do so or on the basis of our legitimate interests pursuant to Art. 6 para. 1 lit. f GDPR.

Subject to legal or contractual permissions, we process or let data be processed in a Third Country only if the requirements of Art. 44 ff. GDPR are fulfilled. Accordingly, the processing is carried out, for example, on the basis of special guarantees, such as the officially recognized confirmation of an EU adequate data protection level e.g., with regard to the USA, the “Privacy Shield” or compliance with officially recognized special contractual obligations (so-called “Standard- Terms”).

  1. Data Security

We implement appropriate technical and organizational measures to protect your personal data from unauthorized access, disclosure, alteration, and destruction. We point out that the privacy of any transferred data cannot be guaranteed in the event you contact us by e-mail or in any other e-mail correspondence without encryption or use of a qualified electronic signature. As a general matter of IT technology, third party access to e-mail content cannot be excluded.

  1. Data Retention

We retain your personal data for as long as necessary to fulfill the purposes we collected it for, including any legal, accounting, or reporting requirements.

  1. Your Rights

You are entitled:

  • to request information about your personal data processed by us, in accordance with Art. 15 GDPR. In particular, you may request information about the purposes of processing, the category of personal data, the categories of recipients to whom your data have been or will be disclosed, the planned storage period, the existence of a right to rectification, erasure, restriction of processing or objection to processing, the existence of a right to lodge a complaint, the source of your data, in case it has not been collected by us, and any existence of automated decision-making including profiling and, in such case, meaningful information on its details;
  • to immediately request the rectification of inaccurate personal data or the completion of personal data stored by us, in accordance with Art. 16 GDPR;
  • to request the erasure of your personal data stored by us, in accordance with Art. 17 GDPR, unless the processing is necessary to exercise the right of freedom of expression and information, to comply with a legal obligation, for reasons of public interest or for the establishment, exercise or defense of legal claims;
  • in accordance with Art. 18 GDPR, to obtain restriction of the processing of your personal data, if you contest the accuracy of the data, if the processing is unlawful, but you oppose to have the data erased, and if we no longer need the data, but you need it to establish, exercise or defend legal claims or if you have objected to processing pursuant to Art. 21 GDPR;
  • in accordance with Art. 20 GDPR, to receive the personal data you have provided to us in a structured, commonly used and machine-readable format or to request its transmission to another controller;
  • in accordance with Art. 7 para. 3 GDPR, to withdraw your consent at any time. As a result, we are no longer allowed to continue processing data based on this consent in the future and
  • to lodge a complaint with a supervisory authority, in accordance with Art. 77 GDPR. As a general rule, you can contact the supervisory authority of your habitual residence or workplace.
  1. Revocation Right

If your personal data is processed on the basis of legitimate interests pursuant to Art. 6 para. 1 lit. f GDPR, you have the right to object to the processing of your personal data, in accordance with Art. 21 GDPR, insofar as there are grounds relating to your particular situation.
